Muslim Woman Sued After Refusing to Wax a Trans Woman

A spa in Canada is facing charges after a Muslim employee refused to wax a trans woman patient, stating that it went against her religion.

Muslim women are not allowed to come in physical contact with any male that is not her husband, or in relation to. At the beauty salon she worked at, she strictly dealt with female patients at the beauty salon, and her employer was completely fine with it.

One day a trans woman arrived at Mad Wax beauty salon to get her body waxed, only for the Muslim woman to realize she was actually a he. 

Normally Mad Wax beauty salon has a designated person who performs the wax treatments on men, but they were out on sick leave that day. The patient was then turned away because no one else was available to wax them.

The trans woman, who sued the beauty salon, brought his complaint to the Human Rights Tribunal of Ontario.
In the application, the trans woman stated that the spa’s “refusal to provide me with leg-waxing services because I am a Transgender woman, and their disclosing my name, gender identity and personal information to various media outlets has left me feeling threatened, exposed, with my rights violated in terms of seeking services as a woman in the Windsor-Essex community.”

The trans woman is seeking $50,000 for the “immense harm to my dignity,” that was received following their day at the beauty salon.

Mad Wax continues to protect their employee, stating that they are accepting of different religious beliefs.

Jason Carruthers, who is the president and CEO of Mad Wax Windsor Camp Inc., stated that he, in particular, is respectful of his employee’s beliefs.

“All clients regardless of sex, gender, gender identity or sexual orientation are welcome,” Carruthers stated, “However, we also welcome staff members and respect their religious beliefs and feelings of safety and dignity in regards to the right not to perform waxing services on males or male genitals.”

Carruthers’ attorney, Ray Colautti, also chimed in saying, “respects its own staff and religious beliefs and feelings of safety and dignity in regards to the right in not performing waxing services that they don’t feel comfortable providing.”

 This is not the first time for a person to take a business to court for not serving them. Most notably, in the United States, there is the case of Masterpiece Cakeshop v. Colorado Civil Rights Commission, where two Christians bakers refused to bake cakes for same-sex wedding services. This case has not received a ruling from the Supreme Court yet.
